6-1-1. Creation of Fire Department. There is hereby created and established a volunteer fire department for the City to be known as the Parowan Volunteer Fire Department. The members of the Department may adopt a constitution, by-laws, and such other rules and regulations as may be necessary for the effective operation of the Department, including requirements for membership therein.

6-1-2. Officers. A Fire Chief and such other officers as may be provided for in the constitution and by-laws of the Department shall be elected or appointed annually and their names submitted to the City Council for confirmation.

6-1-3. Duties and Powers of Members. The members of the Fire Department, under the direction of the Fire Chief, shall have the duty of extinguishing fires and of protecting life and property within the City. The Fire Chief shall have the sole and entire command over all officers and members of the Department at fires, and in his absence the highest ranking officer of the Department who is present at the fire shall have such command. The members of the Department may periodically inspect business establishments to check for fire hazards, and may, at the request or with the permission of the owner, inspect private homes for fire hazards, and may divide the City into fire districts. The members of the Department shall keep the fire apparatus owned by the City in proper condition for immediate use and shall make such reports to the Mayor and City Council as from time to time requested.

6-1-4. Compensation. Compensation for all members of the Fire Department shall be fixed by resolution of the City Council from time to time.

6-1-5. Blockading Streets. Whenever a fire shall occur it shall be lawful for the Fire Chief, or the officer in command, to blockade any street, avenue, alley, sidewalk or other place, if in his judgment it is necessary to secure the efficient working of the men and equipment under his command, and to protect the safety of the public. It shall be unlawful for any person to break through such a blockade.

6-1-6. Right to Enter Premises. The members of the Fire Department shall have the right to enter upon any premises for the purpose of investigating, extinguishing, or controlling fires.

6-1-7. Use of Water. The Fire Chief or other officer in command shall have the right to use water from any source for the purpose of extinguishing fires or for saving property in danger of being destroyed by fire.

6-1-8. Inspection After Fire. The Fire Chief, or other member of the Department appointed by him shall, after the extinguishing of any fire, make a prompt and thorough investigation of the cause of the fire, the time of its breaking out, the amount of loss and insurance, a description of the affected buildings and premises, and shall secure all other useful information and data available and shall record the same in a record book kept for that purpose in the office of the Department. If the officer making such investigation determines that the fire appears to be arson or other intentional starting, he shall immediately notify the State Fire Marshal of that fact and shall within one week following the fire file with the State Fire Marshal a written report, setting forth all of the facts and circumstances regarding the fire and such other information as may be required by the State Fire Marshal.

Chapter 2 -- FIRE CODE

Section 6-2-1. Adoption of Fire Code Section 6-2-2. Amendments to Fire Code Section 6-2-3. Adoption of Life Safety Code Section 6-2-4. Copies to be Maintained by Recorder

6-2-1. Adoption of Fire Code. Parowan City hereby adopts the most current International Fire Code, as promulgated by the nationally recognized code authority and approved by the Utah Fire Prevention Board of the State of Utah. Said code is hereby adopted as the fire code for Parowan City, and shall have the same force and effect as though fully set forth herein.

6-2-2. Amendment to Fire Code. As the annual amendments, appendices and/or supplements to the most updated International Fire Code is adopted by the State of Utah, the same shall be submitted to Parowan City Council for review and adoption as determined appropriate.

6-2-3. Adoption of Life Safety Code. The Life Safety Code, National Fire Protection Association Pamphlet #101, 1973 Edition, is hereby adopted as the life safety code for the City and shall have the same force and effect as though fully set forth herein.

6-2-4. Copies to be Maintained by Recorder. The City Recorder shall keep on file in his office at least three copies of each of the codes adopted by 6-2-2 and 6-2-3. Such copies shall be open to inspection by the public in the manner required by State Law.

Chapter 3 -- FEES

Section 6-3-1. Fire Impact Fees

6-3-1. Fire Impact Fees. The City Council may require an applicant to pay an impact fee for requested services from the City for use of its Fire Department. The imposition of impact fees shall be based upon the current schedule of impact fees for the Fire Department located within the Parowan City limits. This impact fee shall be assessed against all development activity, as may be applicable, within the Parowan City limits. The impact fee for the Fire Department shall be established and adjusted, by resolution, as necessary to ensure that the impact fees are being reasonably imposed for the service being provided based upon and reasonably related to the development activity.

All funds collected as Fire Department fees shall be placed in a separate fund to be known as the Parowan City Fire Department Capital Improvement Fund for use in the future expansion of the Fire Department for Parowan City, Utah
