TITLE 13 -- ORDINANCES Chapter 1 through Chapter 3 TITLE 13 -- ORDINANCES Chapter 1 -- ADOPTION OF 1981 PAROWAN CITY CODE Section 13-1-1. Title and Citation Section 13-1-2. Repealer Section 13-1-3. Savings Clause Section 13-1-4. Severability Section 13-1-5. Adoption of State Constitution and Laws 13-1-1. Title and Citation. This code shall be known as and may be cited as the "Parowan City Code, 1981". All the provisions thereof shall become effective immediately upon the effective date that this Ordinance is adopted and posted as required by law. 13-1-2. Repealer. Except as otherwise provided in 13-1-3 or as specifically provided elsewhere in this code, all Ordinances of Parowan City which are in conflict with the provisions of this code are repealed as of the effective date of this code. 13-1-3. Savings Clause. The repealer contained in 13-3-2 notwithstanding, all Ordinances in force immediately prior to the effective date of this code shall continue in force for the purpose of all rights acquired, fines, penalties and forfeitures and liabilities incurred and action therefor. 13-1-4. Severability. If any Chapter, Title, Section, subsection, paragraph, subparagraph, or part of this Code or any subsequent amendments thereto, or the application thereof, is held to be unconstitutional or void or otherwise invalid, the remainder of this Code and the application thereof shall not be affected thereby. 13-1-5. Adoption of State Constitution and Laws. The provisions of the Constitution of the State of Utah and all provisions of State Law relating to cities of the third class are hereby adopted just as if they were specifically ordained and fully set forth in this Code. Chapter 2 -- FORM OF ORDINANCES Section 13-2-1. Items to be Contained in Ordinances Section 13-2-2. Requirements as to Form Section 13-2-3. Effective Dates Section 13-2-4. Recording, Numbering, and Certification 13-2-1. Items to be Contained in Ordinances. All Ordinances shall contain and be in substantially the following form and order: a) a number; b) a title, which indicates the subject matter of the Ordinance; c) a preamble which states the need or reason for the Ordinance; d) an ordaining clause which shall be: "Be it ordained by the City Council of Parowan City, Utah"; e) the body or subject of the ordinance; f) when applicable, a statement indicating the penalty for violation of the Ordinance or a reference to some other Ordinance which prescribes such penalty; g) a statement of the effective date of the Ordinance or the date when the Ordinance shall become effective after publication and posting as required by State law; h) a line for the signature of the Mayor or acting Mayor to sign the Ordinance; I) a place for the City Recorder to attest the Ordinance and fix the seal of the City. 13-2-2. Requirements as to Form. Ordinances passed by the City Council shall be signed by the Mayor, or if he is absent, by the Mayor Pro Tempore, or by a quorum of the City Council. All Ordinances shall be recorded by the City Recorder before taking effect. No Ordinance shall be void because it fails to conform to the requirements of 13-1-1 (1), (2), (3), or (4). 13-2-3. Effective Dates. All Ordinances, except the Ordinance which shall enact this code, shall be deposited and recorded by the City Recorder as provided in 13-2-4 and shall be published by posting complete copies thereof in at least three public places in the City before becoming effective. Ordinances shall become effective twenty days after publication or posting or thirty days after passage by the City Council, whichever is more remote from date of final passage. Ordinances may, however, become effective at a later or earlier date after publication if so provided in the Ordinance. 13-2-4. Recording, Numbering, and Certification. The City Recorder shall record, in a book used exclusively for that purpose, all Ordinances passed by the City Council. All Ordinances shall be numbered with each number to contain the year the Ordinance was finally passed by the City Council followed by a hyphen, followed by a sequential number beginning with the first Ordinance passed in each year (i.e. 1978-1, 1978-2... 1979-1...). The Ordinance which enacts this code shall be numbered 1978-1. Immediately following each Ordinance, the recorder shall make a certificate stating the date of passage and of publication of the Ordinance. Chapter 3 -- AMENDMENTS TO CODE Section 13-3-1. Amendments to be by Ordinance Section 13-3-2. Amendment by Reenactment of Section 13-3-1. Amendments to be by Ordinance. All amendments made to this Code shall be by Ordinance. 13-3-2. Amendment by Reenactment of Section. No amendment shall be made by interlineation or by reference to a Title, Chapter, or Section only. All amendments shall be made by setting forth and reenacting each amended Section in full as amended.
