NOTICE OF CERTIFICATION OF PETITION FOR ANNEXATION

Pursuant to Section 10-2-405(2)(c)(i), U.C.A., Parowan City, Utah, hereby gives notice as follows:

1.  On August 4, 2023, a petition proposing the annexation of current Iron County parcels: C-1023-0000-0000, C-1009-1009-0001, C-1061-0000-0000, consisting of approximately 75.612 acres.

2.  On, August 24, 2023, the Parowan City Council accepted the Petition to be further considered and authorized the Petition to certified by City Staff.

3.  On September 26, 2023, Parowan City Staff certified that the Petition meets the requirements of Utah State Law and notice is hereby provided to the Parowan City Council, Rich Piggott (contact sponsor), and the Iron County Commission.

4.  The area proposed for annexation in the petition is described as follows:

5. The complete Annexation Petition is available for inspection and copying at the Parowan City Recorder’s Office, 35 N. 100 E., Parowan, Utah, Monday through Thursday between the hours of 9:00 a.m. and 4:30 p.m. and Friday from 9:00 a.m. to 12:00 p.m.

6.  Parowan City may grant the Petition and annex the above-described area unless a written lawful protest to the Annexation Petition is filed with the Iron County Clerk, P.O. Box 429, Parowan, UT, 84761, c/o Jon Whittaker, or delivered to the Iron County Clerk’s Office located at 68 South 100 East, Parowan, Utah, 84761.  A copy of the protest must also be delivered to the Parowan City Recorder at the address noted above on the same date that the protest is filed with the Iron County Clerk.  Any protest must be filed as herein state by not later than October 26, 2023.

7.  If no lawful protests are received, the Parowan City Planning Commission will hold a public hearing on November 1st, 2023, in the Parowan City Council Chambers located at 35 E. 100 N., Parowan, Utah to consider a request to annex this property.

8.  If no lawful protests are received, the Parowan City Council will hold a public hearing on Thursday, November 9th, 2023, in the Parowan City Council Chambers located at 35 E. 100 N., Parowan, Utah, to consider the request to annex these properties.

9.  The area proposed for annexation to Parowan City will also automatically be annexed to have Parowan City provide fire protection, and emergency services or law enforcement services, as applicable.

10. The properties proposed for annexation to Parowan City will automatically be withdrawn from Iron County providing fire protection, and emergency services or law enforcement services, as applicable.

PLEASE NOTE:  "Lawful protest," as mentioned in paragraph 6, is defined in Utah Code Annotated 10-2-407 as follows:

10-2-407.  Protest to annexation petition -- Planning advisory area planning commission recommendation -- Petition requirements -- Disposition of petition if no protest filed -- Public hearing and notice.

(1) A protest to an annexation petition under Section 10-2-403 may only be filed by:

    (a) the legislative body or governing board of an affected entity;

    (b) an owner of rural real property located within the area proposed for annexation;

    (c) for a proposed annexation of an area within a county of the first class, an owner of private real property that:

         (i) is located in the unincorporated area within 1/2 mile of the area proposed for annexation;

         (ii) covers at least 25% of the private land area located in the unincorporated area within 1/2 mile of the area proposed for annexation; and

         (iii) is equal in value to at least 15% of all real property located in the unincorporated area within 1/2 mile of the area proposed for annexation; or

    (d) an owner of private real property located in a mining protection area.
